Under the terms of the settlement APP agrees to withdraw its appeal against a federal district court ruling that MDCO's application for Hatch Waxman patent term extension of the Angiomax composition of matter patent was timely filed. After the appeal is withdrawn, all pending litigation regarding the Angiomax patent will have been resolved.
As part of the settlement agreement, MDCO licensed APP and an affiliate of APP to launch a generic bivalirudin product in the US on 1 May 2019. Moreover, APP has agreed to manufacture and supply Angiomax finished product to MDCO.
APP has also agreed to license and supply to MDCO a portfolio of generic products which are used in therapeutic areas such as treatment of acute cardiovascular, neurological and infectious diseases in hospital.
