The letter, received on May 17, also states that not filing a quarterly report on form 10-Q on time is a material violation of the company's listing agreement with NYSE MKT and as such, the latter has the right to suspend and, unless quick corrective action is taken, remove ERBA Diagnostics' securities from the exchange.
The firm has been granted a period by the end of the month to submit a plan to regain compliance by August 15. ERBA Diagnostics is already working on such a plan, it added.
The company has delayed the submission of its quarterly report on form 10-Q due to delays in filing of its 2012 annual report on the same form.
